THE FOLLOWING TERMS AND CONDITIONS SHALL APPLY TO ANY AND ALL FANTASY GAMES AND CONTESTS OF BUCKINFANTASY.COM.
THESE TERMS AND CONDITIONS CONTAIN IMPORTANT LEGAL DISCLAIMERS AND REGULATIONS THAT SHOULD BE READ BY ALL USERS.
BY PARTICIPATING IN ANY BUCKINFANTASY .COM CONTEST (GAME) IT IS IMPLIED THAT USERS HAVE READ AND AGREE TO ALL OF THE FOLLOWING TERMS AND CONDITIONS.
ALL CONTESTS ARE INTENDED FOR ENTERTAINMENT PURPOSES ONLY AND ARE GOVERNED BY UNITED STATES LAW.
1. Contest of skill
All Buckinfantasy.com games are a contest of skill designed to promote awareness and increased knowledge of each games respective sport and are subject to all federal, state, and local laws and regulations. These contests are for personal use and entertainment purposes of the users and are not to be used for or in conjunction with any form of gambling. The winner of each game will be determined by the user’s ability to select a team of contestants that have the highest total combined earnings based on the user’s knowledge of the contestants, their respective sport, and the rules of the Buckinfantasy.com game. The users will be competing against other users and the overall odds of winning are dependant on the number of users in each game along with the knowledge of the users.
2. Eligibility
Users of Buckinfantasy.com games must meet ALL of the following eligibility requirements to be considered an “Eligible User”:
- Must be a legal resident of the United States of America, Washington D.C., or Canada (Excluding residents of Arizona, Florida, Iowa, Louisiana, Maryland, Minnesota, Montana, Nebraska, North Dakota, Vermont, Puerto Rico, and Quebec)
- Must be eighteen (18) years of age or older.
- Must provide Buckinfantasy.com with name, full address (street, city, state, and zip code), phone number, email address, and date of birth at the time of registration. It is the users responsibility to provide address, or email address changes in order to receive prizes.
- User must pay required registration fee.
- Users that reside in an area where the buckinfantasy.com games are restricted or prohibited by any federal, city, state or local law will not be eligible.
- Any official employees of Buckinfantasy.com LLC and their immediate family members are not eligible.
- All users may be required to show proof of age, identity, and residence when claiming prizes.
Only users deemed eligible will be awarded prizes. Excluded users that participate in the Buckinfantasy.com fantasy games will have their team name listed in standings but will not be eligible to win any cash or prizes.
3. Registration
All users must sign up and create a team at www.Buckinfantasy.com. Payment will be made through a secure payment gateway provide by the website with an authorized credit card or by cashiers check or money order (no personal checks) with completed entry* form mailed to:
*Please note entries received by mail must have completed entry form with proper payment enclosed and must be received three (3) days prior to registration deadlines in order to verify registration and process payment.
A user will not be officially entered until all sign up information, team creation, and payment processing has been completed. Buckinfantasy.com is not responsible for any lost entries or technical difficulties encountered by users including but not limited to internet connection, computer problems, payment processing, incomplete entries or mail delays or loss. No entries will be accepted after the official registration deadline. The official registration deadlines and fees will be outlined in the rules of each Buckinfantasy.com fantasy game.
4. Acceptance of fees
All users shall accept and agree to pay all fees associated with the use of the Buckinfantasy.com website and active participation in the contests. All fees charged to an authorized credit card by a user that signs up and/or participates in any of the contests shall be deemed legitimately incurred by the user. The user agrees to be solely responsible and liable for all charges.
All users are solely responsible for reporting and paying applicable taxes and fees on prizes. Winners of prizes with a value of $600.00 or more will receive a federal 1099 form.
All dollar amounts specified are in U.S. Currency.
5. Refund Policy
Any request for refund must me made in writing via email to: info@buckinfantasy.com. Within three (3) days of purchase. No refunds will be given after the official registration deadline or once an event is underway. Once a refund has been made user is not eligible for any prizes. All refunds will be subject to a ten (10) dollar service charge per transaction.
6. Prize Winners
All winners will be notified by mail at the address provided at sign up within fourteen (14) days of the official results. A complete list of winners will be posted on website in a timely manner after results have been made official. All winners must claim prizes within ten (10) days of receiving notification by returning the proof of Identification and eligibility forms by mail to: info@buckinfantasy.com.
If prizes go unclaimed because of but not limited to: failure of winner to return completed claim forms within the time limits stated above, notification returned not deliverable, winner is resident of excluded areas stated previously, failure or refusal to supply additional identification or eligibility information requested by buckinfantasy.com administrator, the winner will be disqualified and prize will be forfeited.
7. Prizes/Payoff
All advertised prizes and payoffs are based on a minimum number of entries (see Rules for details for each individual contest). If the minimum number of entries is not met in any contest Buckinfantasy.com LLC reserves the right to prorate prizes and/or payoff in any way that they see fit or cancel contest at any time without notice and provide a refund to all participants.
8. Changes to terms and/or rules
Buckinfantasy.com LLC reserves the right and has the sole discretion to change, modify, add, or delete any and all of the terms, rules, site functions, and contests without notice or any liability. Changes will be effective immediately upon posting on the website or other notification to users. Any use after changes will imply that user has agreed to comply with new terms/rules or other changes.
9. Disqualification
Buckinfantasy.com LLC reserves the right to disqualify a user at any time without notice to the user for any reason that the administrator of Buckinfantasy.com deems appropriate. Buckinfantasy.com LLC has the sole discretion in decisions of disqualifications. All disqualifications will result in a forfeit of all registration fees and disqualified user will not be eligible for prizes.
10. Regulatory Challenge
In the event that any of the contests or prizes associated with Buckinfantasy.com are challenged by any legal or regulatory authority, BuckinFantasy.com LLC reserves the right and has the sole discretion to modify or discontinue the contest, and/or not award prizes or disqualify users without notice or liability to any users.
11. General Release
All users shall understand and agree that Buckinfantasy.com LLC is not responsible for any inaccuracies or typographical errors on the website or in any forms of advertisement. By registering, all users waive their rights of recovery against Buckinfantasy.com LLC, its members, and employees from any liabilities whatsoever including but not limited to: claims, costs, expenses, or injuries arising from participation in any Buckinfantasy.com contest or from acceptance of any prizes. Buckinfantasy.com LLC shall not be liable for any consequential, direct, indirect, incidental, punitive, or special damages. All disputes shall be resolved individually without any form of class action. Buckinfantasy.com LLC shall not be responsible for any damage to user’s computer hardware or software or loss of connection while using the website.
12. Copyrights
Any and all material found on any page within the domain of http://www.buckinfantasy.com is copyrighted information protected by the copyright act of 1976. Any use of such materials without written consent of Buckinfantasy.com LLC will be considered in violation of this act. Buckinfantasy.com LLC has the right to, and will, protect its copyrighted information by any means necessary.
13. Privacy Policy
All information given at sign-up will be stored in a secure database and be considered to be property of Buckinfantasy.com LLC. The information will be used for notification of winnings, upcoming events, and any other need for contact that Buckinfantasy.com sees fit. The information will not be shared with any third parties for advertising or promotional uses.
